Cody William Bates, 24, pleaded guilty through defence lawyer David Chow on Tuesday to manslaughter using a firearm in the slaying of Ali Khamis.In an agreed statement of facts read into court, Bates admitted he and two others went to the Shawnessy Community Centre with a sawed-off, single-shot, 12-gauge shotgun to set up the 31-year-old victim up for a drugs purchase and rob him.Justin Gittens, 25, and Jason Woods, 21, also face manslaughter charges in connection with the late-night incident on June 6, 2006.Both co-accused said the loaded gun was to be used in the heist and that it accidentally fired, hitting Khamis in the face, when Gittens was sliding it out of his sleeve.Crown prosecutor Vicky Faulkner, reading from the facts, said "shooting Khamis was not part of the robbery plan."She said the plan was concocted because Khamis had previously told Woods he did not like Bates selling drugs in his territory and indicated he was going to rob Bates."Woods was concerned for the safety of Bates and advised Bates that Ali Khamis was planning to rob him," said Faulkner. "Bates decided that he would rob the victim first."Bates, she said, did not know Khamis personally and had never met him before.Chow and prosecutors Patricia Yelle and Faulkner will make their sentencing arguments to Court of Queen's Bench Justice Neil Wittmann on June 15
